Testul Сurții Europene a Drepturilor Omului aplicat în contextul principiului legalității incriminării și pedepsei

Atunci când Curtea Europeană a Drepturilor Omului constată o ingerință într-un drept garantat de Convenția Europeană a Drepturilor Omului, ea verifică, mai întâi de toate, dacă ingerința este prevăzută de lege. Dacă răspunsul este afirmativ, atunci Curtea Europeană a Drepturilor Omului analizează dacă ingerința urmărește unul sau mai multe scopuri legitime. Din nou, dacă răspunsul este afirmativ, în cele din urmă, Curtea Europeană a Drepturilor Omului verifică dacă ingerința este necesară într-o societate democratică. Acest algoritm de analiză mai este numit „triplu test”. Acești pași sunt urmați în majoritatea cazurilor. Totuși, în acest studiu se arată că în contextul articolului 7 din Convenția Europeană a Drepturilor Omului (articol care garantează principiul legalității incriminării şi al legalității pedepsei), Curtea de la Strasbourg aplică, în esență, testul calității legii, cu unele particularități.
