Acest articol explorează originea și evoluția termenului „drept transnațional”, în special contribuția fundamentală a lui Philip Jessup. În 1956, Jessup a introdus conceptul, definindu–-l ca incluzând atât dreptul internațional public și privat, cât și alte reguli neconvenționale. Jessup a criticat limitările abordărilor juridice tradiționale, propunând o viziune integrată ce recunoaște rolul actorilor nestatali și al normelor de soft–law în reglementarea transnațională. De asemenea, în articol se discută despre rezistența inițială față de acest concept și despre acceptarea și extinderea sa ulterioară, subliniind importanța sa în era globalizării. Autorul concluzionează că dreptul transnațional reprezintă o schimbare fundamentală în gândirea juridică, reflectând complexitatea unei lumi globalizate și interdependente.
