Rezumat

Protecția și garantarea drepturilor lucrătorilor migranți a fost subiectul unei preocupări constante în cadrul sistemului ONU. Crearea ONU și adoptarea Cartei ONU au pus fundamentul pentru o nouă etapă a relațiilor interstatale în domeniul protecției drepturilor omului. Carta ONU reprezintă primul tratat internațional multilateral care a inițiat dezvoltarea cooperării interstatale pe
segmentul protecției drepturilor omului. În pofida faptului că în cadrul procesului de elaborare a cadrului juridic internațional pertinent statele cu diferite sisteme politice și sociale în mod deliberat nu aveau intenția de a concretiza conținutul unei bune părți a conceptelor elaborate și ofereau definiții cu caracter general. Cu toate acestea, la nivel universal au fost adoptate o gamă largă de instrumente internaționale care stabilesc un cadru juridic general privind reglementarea migrației internaționale și standardele privind drepturile omului și libertăților fundamentale, inclusiv și a drepturilor lucrătorilor migranți.
