From a practical point of view, there is no longer a need for a consolidated theory of the Pauline action to explain all its aspects, but it would be sufficient to evoke the general principle in the form of the prohibition of defrauding the rights of creditors, which should be developed in a praetorian way through judicial precedents. The Pauline action is built on some derogations from the fundamental principles of civil law, namely the principle of freedom of contract, the relativity of the effects of the contract and the inviolability of property.
